Definitions

The terms and words listed below have the meaning indicated, as it is understood that the terms defined in the singular are also defined in the plural and vice versa.

Customer: Means any person who buys one or more Products offered through the On Line Store by accepting these General Terms.

Parties: It means jointly Wezzi.it and customers.

General Terms of Sale: This General Terms and any future new versions that can be published in the On Line Store by Wezzi.it.

Online store: means the virtual store, operated by PASCALI S.r.l. and accessible through the URL  https://www.wezzi.it/ through which you can buy the Products.

Contracts: means contracts concluded between PASCALI S.r.l. and customers through the On Line Store.

Orders – This means purchase orders for Products to Customers, in accordance with these General Terms of Sale.

Price: This means the price of the Products and/or the supply of the Service as indicated in the On Line Store at the Products.

Consumer: according to the relevant definition set out in Article 3 D. Lgs. 206/2005 (Consumer Code) is the individual acting for purposes unrelated to business, business, craft or professional activity, if any, carried out.

Service: Means the service offered in the On Line Store.

Product: means the goods offered in the On Line Store.

Shipping charges: This is the amount due for the delivery of the product.

 

1. OBJECT

1.1 The General Terms of Sale governs all contracts concluded between the parties and are an integral part of this.

1.2 The General Terms of Contract Sale are also changed from time to time in view of any regulatory changes. The new General Sales Terms will be effective from the date of publication on the On Line Store.

 

2. PRICE

2.1 The Price is expressed in a euro. The applicable Price is the price posted in the On Line Store when the Orders are sent by customers.

2.2 The price exposed includes the value-added tax (I.V.A.) provided for the type of asset.

 

3. CART

3.1 The cart allows you to immediately check the products entered, with their I.V.A. unit cost included. You can decide which quantities to buy for each type of product you choose, or

one or more products from the cart that you have decided you no longer want to buy. A series of buttons allow you to:

Update the cart after making cancellations or quantity changes;

Delete the content products individually;

Return to the home page.

3.2 Once you have filled the cart with the desired products, you can make the actual purchase and choice of the form of payment.

 

4. CONCLUSION OF CONTRACTS

The contract will be perfected through the following steps:

4.1 With the submission of the Order, the customer will send a proposal to Wezzi.it to purchase the selected product or products.

4.2 Contracts are defined as concluded between the Parties when the Customers receive the Order Confirmation with the assignment of the order number. The Order Confirmation contains a summary of the General Terms of Sale, the information on the right of withdrawal, information about the essential characteristics of the product and the detailed indication of the price, means of payment and delivery costs with guidance of delivery times.

4.3 With the submission of the Orders, customers declare that they have reviewed all the instructions regarding the way to purchase the product and have accepted the General Terms in full and have reviewed all the additional information contained in the On Line Store, also recalled via link.

4.4 Wezzi.it the right is not to give purchase orders that do not give sufficient guarantees of solvency or that are incomplete or incorrect, or if the user is not available.

Products.

4.5 It is understood that the image accompanying the description card of a product may not be perfectly representative of its characteristics but differ in color tones, sizes, accessories featured in the figure. The presentation of each product contained on the site is merely an example and does not constitute a claim or guarantee by the actual characteristics and performance of the goods sold.

4.6 The parties, at all stages of the formation and conclusion of the contract, must behave according to the general principles of fairness and good faith enshrined in Articles. 1175, 1337 and 1375 of the Civil Code.

 

5. PAYMENT METHOD

Wezzi:en allows customers several payment methods listed below:

5.1 PAYPAL. Wezzi also uses the PAYPAL system for online payments.

Once you have chosen this payment method, you will be directed to Paypal's secure server, which you will have to follow.

Under no circumstances Wezzi.it can therefore be held liable for any damage caused to the Customer by the use of the services offered by Paypal.

5.2 Credit card. Accepted circuits for payments on the site are Visa Circuit, MasterCard Circuit and Master Circuit.

5.3 Early Bank Transfer On the site you will find indicated in the special area "PAGAMENTS" on the home page bank details to be able to make the transfer. It is recommended that you enter the order number and date in the reason for the transfer. Wezzi.it reserves the right not to initiate orders with Bank Transfer without the actual credit of the amounts. The execution of the contract that consists of sending the Products or dispensing the Services will take place only after the actual credit of the amount due to the current account.

5.4 MyBank Immediate Transfer

5.5 Mark on delivery. If you choose this mode, the customer will make the payment directly to the delivery of the product only by cash.

 

6. PRODUCT DELIVERY

6.1 Products are delivered to the address indicated by customers.

6.2 Customers, or other persons appointed by customers who are at the address indicated for the delivery of the Products in the Order Confirmation, are required to verify, at the time of delivery, that the packaging/packaging of the Products is intact, un damaged or otherwise altered.

6.3 Any damage to the packaging/packaging of the Products must be immediately disputed by customers by placing a written control reserve on the proof of delivery.

6.4 In the event that the carrier has been chosen by the Customer outside of those proposed during the purchase, the risk of damage and the periment of the Products is transferred to the customer already at the time of delivery to the carrier itself, precluding any dispute regarding the external characteristics of what was delivered. In the latter case, any dispute must be made directly by the Customer against the carrier.

 

7. LEGAL GUARANTEE OF COMPLIANCE

All products marketed enjoy the legal guarantee of compliance provided by Articles 128 and ss. of the Consumer Code that covers any compliance defects of the purchased items, existing at the time of delivery and that occur within 2 years of delivery itself. Compliance defects and, therefore, the legal guarantee exclude any defects or damages caused by accidental events or the customer's liability for the use of the products does not comply with their intended use or effect of normal wear. In order to qualify for this guarantee, you must report the compliance defect within two months of the discovery, subject to termination with communication addressed to the Wezzi.it, accurately indicating the defects and defects found.

The Customer may ask, at his choice, the seller to repair the property or replace it, at no cost in both cases, unless the required remedy is objectively impossible or excessively burdensome compared to the other. The Customer may, of his choice, request a suitable price reduction or termination of the contract where: repair and replacement are impossible or excessively onerous; The seller did not repair or replace the property within the appropriate time as provided for in paragraph 5 Art. 130 Consumption code; the replacement or repair carried out previously has caused considerable inconvenience to the consumer.

 

8. SHIPPING COSTS

Shipping costs will be calculated automatically and will be indicated, separately from the Product Price, before the Order is sent by customers.

 

9. RIGHT OF WITHDRAWAL AND ITS EXCLUSIONS

9.1 "Consumers" customers according to the relevant definition of art. 3 D. Lgs. 206/2005 - that is, an individual acting for purposes outside business, business, crafts or

if they are to be carried out, they are entitled, under the senses and for the effects of art. 52 of D. Lgs. 206/2005 as amended by D.Lgs. 21/2014 to withdraw from the Agreement without having to provide any reason within 14 days of receipt of the Products.

9.2 Customers who cannot define themselves as consumers under this definition and in particular individuals or legal entities acting for purposes related to their business, business, craft or professional activities are therefore excluded from this right.

9.3 The Right of Withdrawal may be exercised by the Consumer Customer with any explicit declaration of the decision to withdraw from the contract, for example it can send communication by e-mail to the costumerservice@wezzi.itaddress. The right to withdraw can also be exercised using the withdrawal form available at the following link (Withdrawal Form), but it is not mandatory.

9.4 You must return the products to Wezzi.it within 14 days of the date you sent the notice of withdrawal. The cost of returning the Products as a result of the exercise of the right

will be paid by the Consumer Customer under and within the limits of art. 57 D. Lgs. 206/2005 and subsequent modifications.

9.5 If the right of withdrawal is exercised in accordance with the manner and terms set out in this article, Wezzi.it agrees to refund all payments received by the Consumer Customer in the shortest time

within 14 days of receiving the notice of withdrawal. Unless you expressly indicate a different refund method, Wezzi.it will use the

same means of payment used by the Customer, at no cost to the customer.

9.6 Wezzi.it may withhold the refund until you have received the Product or until you have provided proof that you have returned it, depending on the situation

check before. Please note that all payments made to the Consumer Customer for Wezzi.it including any original shipping costs will be refunded to the Consumer Customer. As regards these, under art. 56 paragraph 2 D.Lgs. 206/2005 and subsequent changes Wezzi.it is not obliged to reimburse the additional costs if the consumer has expressly chosen a

type of delivery other than the least expensive type of delivery offered by the trader.

9.7 If Customers exercise the right of withdrawal in a manner that does not comply with the terms and conditions in this article, Customers will not be entitled to reimbursement of payments made to Wezzi.it

9.8 The consumer will only be responsible for the decrease in the value of the Product resulting from a manipulation of the asset other than that necessary to establish the nature, characteristics and operation of the Product itself.

9.9 The exercise of the right of withdrawal in the case of art is excluded. 59 D.Lgs. n.206/2005 and subsequent modifications.

 

For example, the following assumptions are indicated by example:

the supply of tailored or clearly customized goods;

the provision of audio or video products or computer software on CDs, DVDs or other media, whose packages have been opened or their seals have been removed after delivery;

the supply of goods that are likely to deteriorate or expire rapidly;

the supply of sealed goods that do not lend themselves to be returned for hygiene or health protection reasons and have been opened after delivery.

 

10. APPLICABLE LAW AND COMPETENT FORUM

10.1 The General Terms and Contracts are governed by Italian law and must be interpreted in light of this. Any contract issue will be subject to Italian jurisdiction. In

In particular, according to art. 66-quater of D.lgs. 206/2005 (Code of Consumption), here is expressly recalled the discipline contained in Part III, Title III, Head I of D.lgs. 206/2005.

10.2 In the case of "Consumer" Customer for all disputes arising from this contract, including those relating to its validity, interpretation, execution and resolution, jurisdiction by territory is indefinitely assigned to the Judge of the place of residence or domicile of the Consumer.

11. ONLINE RESOLUTION OF CONSUMER DISPUTES

Wezzi.it informs the Consumer Customer residing in the European Union that the European Commission has set up an online platform that provides an alternative dispute resolution tool. This instrument can be used by the European Consumer to resolve non-judicially any dispute relating to and/or arising from contracts to sell goods and services entered into on the network.
